By accessing or using our website, www.niazsupport.org (the “Site”), and our services, you agree to be bound by the following Terms and Conditions (“Terms”). These Terms govern your use of our Site and the purchase of customised wheelchairs as gifts for recipients in Pakistan. If you do not agree to these Terms, please do not use our Site or services.

 

1. General Terms

1.1 Eligibility:
By using our Site and services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our services on behalf of another individual, organization, or entity, you represent that you have the authority to bind such individual, organization, or entity to these Terms.

1.2 Amendments:
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our Site. Your continued use of our Site and services after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates.

 

2. Orders and Customisation

2.1 Order Placement:
When you place an order for a customised wheelchair on our Site, you agree to provide accurate and complete information. It is our responsibility to obtain the necessary body measurements directly from the gift recipient to ensure the proper customisation of the wheelchair.

2.2 Customisation Process:
Each wheelchair is custom-made based on the specific body measurements we obtain from the gift recipient. The customisation process is tailored to meet the recipient’s needs, ensuring optimal comfort and usability.

2.3 Delivery:
The customised wheelchair is delivered directly to the gift recipient within 4-6 weeks from the time the order is placed. Upon successful delivery, a video capturing the moment is created and sent to the customer as a token of gratitude.

2.4 Acknowledgment of Gifters:
If you choose to provide the gifter’s name at the time of order placement, this name may be engraved or displayed on the customised wheelchair. By providing this information, you confirm that you have the gifter’s consent to include their name.

 

3. Pricing and Payment

3.1 Pricing:
All prices displayed on our Site are in PKR and are subject to change without notice. The price of the customised wheelchair includes all applicable taxes and fees, unless otherwise stated.

3.2 Payment:
Payment for orders must be made in full at the time of placing the order. We accept payments through debit/credit card, bank transfer, western union, remitly, zelle and interac e-transfer. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

3.3 Currency Conversion:
If you are making a payment from outside of Pakistan, currency conversion rates and additional fees may apply, depending on your financial institution.

 

4. Shipping and Delivery

4.1 Shipping:
We offer delivery services within Pakistan, with the wheelchair being sent directly to the gift recipient. Delivery times may vary based on the recipient’s location and other factors beyond our control.

4.2 Delivery Video:
As a token of gratitude, a video of the wheelchair being delivered to the recipient will be sent to the customer. This video serves as confirmation of delivery and is typically provided within 4-6 weeks from the time the order is placed.

 

5. Refund, Return, and Maintenance Policy

5.1 Non-Refundable and Non-Returnable:
Due to the customised nature of the wheelchairs, all sales are final. Once an order is placed and customisation has begun, it cannot be canceled, refunded, or returned. We strongly recommend that you carefully review all details before finalizing your order.

5.2 Free Maintenance:
We are committed to ensuring the long-term usability of our customised wheelchairs. We offer free-of-cost maintenance services to address any issues that may arise with the wheelchair after delivery. Maintenance services are provided at our discretion and may include repairs or adjustments as needed.

 

6. Privacy and Data Protection

6.1 Privacy Policy:
Your use of our Site and services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our Site and services, you consent to the collection and use of your information as described in the Privacy Policy.

 

7. Limitation of Liability

7.1 No Liability for Errors:
We strive to ensure that all information on our Site is accurate and up to date. However, we do not guarantee the accuracy, completeness, or reliability of any information provided. We are not liable for any errors, omissions, or inaccuracies in the information provided on our Site.

7.2 Limitation of Damages:
To the maximum extent permitted by law, Niaz Support and its affiliates, honorary founder, directors and ambassadors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with your use of our Site or services.

7.3 Maximum Liability:
In no event shall our total liability to you for all damages, losses, and causes of action arising out of or in connection with these Terms or your use of our Site or services exceed the amount paid by you for the customised wheelchair.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless Niaz Support and its affiliates, founder, directors and ambassadors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of our Site or services, your violation of these Terms, or your violation of any rights of another.

 

9. Governing Law and Dispute Resolution

9.1 Governing Law:
These Terms shall be governed by and construed in accordance with the laws, without regard to its conflict of law principles.

9.2 Dispute Resolution:
Any dispute arising out of or in connection with these Terms or your use of our Site or services shall be resolved through binding arbitration. The decision of the arbitrator shall be final and binding on both parties.

 

10. Miscellaneous

10.1 Entire Agreement:
These Terms constitute the entire agreement between you and Niaz Support regarding your use of our Site and services and supersede any prior agreements or understandings, whether written or oral.

10.2 Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.3 Waiver:
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
